PROPERTY FINDER SERVICE
We will commence working on your behalf as soon as we have received your signed and dated copy of these Terms & Conditions along with the Retainer fee of £495 (or one off agreed fee for individual viewings if appropriate).
We undertake upon acceptance of your instructions to work with you to find a suitable property for you to purchase as per your detailed brief.
The Client, or Baker & Woods Property Finders, may terminate this agreement at any time but must give written notice of their intension to do so.
We will be expending considerable time and effort on your behalf to find a suitable property for you. Our retainer fee is £495 this covers a search period of 12 months. This fee is non refundable once we have commenced our search. This fee is deductible from you final Success Fee. If after this time we have not been successful in finding your perfect property then we will negotiate a further retainer fee which will again be deducted from your final Success Fee.
We do retain the right to decline a request to provide services for any period of re-registration.
When Baker & Woods Property Finders finds a suitable property, you agree to pay, upon exchange of contracts 1.5% of the agreed purchase price or one.
There is a minimum success fee payable of either £895 upon exchange of contracts.
Baker & Woods Property Finders are able to view individual properties by arrangement. If after we have viewed individual properties on your behalf you then decide to upgrade to the full service Baker & Woods Property Finders reserve the right to charge the 1.5% fee if, after we have introduced you to other properties, you decide to purchase the property we originally viewed on a ‘One off’ basis.
The Client agrees to notify his Solicitor, the identity of Baker & Woods Property Finders and the Client’s agreement to pay commission due to Baker & Woods Property Finders on the purchase of the property
In the event that the Client locates a property, the information about which has not been previously supplied to the Client by Baker & Woods Property Finders then no fee is payable. Baker & Woods Property Finders however, will at the Clients request negotiate on the Clients behalf for the purchase of the property and in the event that the property is purchased by the Client a reduced commission of £350 (fixed fee) shall immediately be due and payable by the Client to Baker & Woods Property Finders.
In the event that more than one of Baker & Woods Property Finder’s clients wish to offer for the same property, information on which has been supplied to them by Baker & Woods Property Finders or through the Agents contacted on the Clients behalf, Baker & Woods Property Finders will act for the first Client who confirms that they wish to make an offer. Baker & Woods Property Finders will inform all concerned parties of the situation.
Where the client works or resides outside the UK the client will in addition to the Retainer and Success Fees pay Baker & Woods Property Finders all additional costs which shall be paid within fourteen days of invoice.
There is currently no VAT charged on any of our fees.
If Baker & Woods Property Finders shall introduce the Client to any third party including but not limited to any builder, surveyor, valuer, conveyancer, mortgage broker or other professional person any introductions do not form part of the services offered by Baker & Woods Property Finders and we shall not be responsible for such third parties work or services.
For the avoidance of doubt, Baker & Woods Property Finders does not directly provide the services of any other professional person.
Details of properties, valuation, reports and other information provided by us are prepared in good faith and are solely for your guidance. They do not form any part of any contract relating to the purchase of any property.
All purchasers must satisfy themselves as to the correctness and accuracy of any details provided by us and we do not accept liability for the views of, or contents of any report prepared by any third party in relation to any property.
We strongly recommend all prospective purchasers to undertake a most careful personal inspection as well as seeking appropriate legal and other advice and to use the services of solicitors, surveyors, valuers and other specialists. The service provided by us is not intended as a substitute to obtaining such advice and accordingly no liability is accepted for any defects in legal title or in the fabric and structure of any property.
Any assignment is accepted on the basis that the final choice of property is the entire responsibility of the client. Whilst we take every care in only introducing responsible and competent professional services, we cannot be held liable under any circumstances for any loss or claim howsoever arising by virtue of any work undertaken for clients by any other party including any party introduced by us. Specific Exclusion: We shall not be liable for any claim howsoever arising in connection with suitability, value or structure of any property introduced by us. Whilst every care taken that all advice given in relation to any property is accurate, such advice can only be by way of opinion for which we cannot accept any legal liability. Any claim by way of consequential damage arising out of any act of omission or commission by us is specifically excluded.
We will when possible communicate with you by e-mail and you agree to this.
Baker & Woods Property Finders also gives due notice, that if any individuals, relatives, companies, partnerships or trusts, with which the contracted applicant is directly involved, should subsequently buy any property, within one year of the date of agreement, and on which Baker & Woods Property Finders has provided particulars, either directly or indirectly by any means, then the original applicant shall be liable for settlement of all fees relative to that property.
This agreement is governed by the laws of England & Wales and the parties to it agree to submit to the exclusive jurisdiction of the Courts of England & Wales.
